Terms of Use

Terms of Use

The agreement between you and Ember, in plain words.

In short

Ember is a focus ritual for your own work. The solo ritual is free to try; Ember Pro is an Apple subscription you can cancel any time. Be kind in Quests: anything abusive is removed and its author loses access. Ember is not medical advice. Questions: hello@emberfocus.io.

1. These terms

These terms apply to the Ember iPhone app, the Ember web app at app.emberfocus.io and this website (together, “Ember”). Ember is made by Malika Sani, doing business as Ember Focus (“I”, “Ember”). By using Ember you agree to these terms and to the privacy policy.

If you use the iPhone app, Apple's Licensed Application End User License Agreement also applies. If the two ever disagree about the app licence itself, Apple's agreement prevails.

2. Using Ember

  • You may use Ember for your own personal work and study.
  • You must be at least 13 years old, and old enough to agree to these terms where you live.
  • An account is optional. If you create one, keep access to your email and Apple Account secure; you are responsible for what is done with your account.

3. Ember Pro and subscriptions

  • Ember Pro is an auto-renewable subscription sold through the App Store, monthly or yearly. The price, period and any free trial are shown in the app before you confirm.
  • The yearly plan includes a free trial for new subscribers; the monthly plan has none. When a free trial ends, the subscription starts and you are charged unless you cancelled at least 24 hours before the trial ended.
  • Payment is charged to your Apple Account when you confirm the purchase or when the trial ends. The subscription renews automatically unless cancelled at least 24 hours before the end of the current period.
  • Manage or cancel in your Apple Account settings. You keep Pro until the end of the period you paid for.
  • Payments and refunds are handled by Apple under its terms; request a refund at reportaproblem.apple.com.
  • Prices may change. A change never applies to a period you have already paid for, and Apple tells you before an increase applies to your subscription.

4. Quests and what you share

In a Quest, other members can see your first name, your check-ins and your flames. By joining you agree to the community promise shown in the app. You must not post anything that is:

  • abusive, harassing, hateful, threatening, sexual or violent;
  • illegal, or that infringes someone else's rights;
  • spam, advertising, links, or contact handles meant to move people elsewhere;
  • someone else's personal information.

Ember has zero tolerance for objectionable content or abusive users. Every check-in can be reported and its author blocked. Check-ins are filtered automatically, a check-in reported twice is hidden at once, reports are reviewed within 24 hours, and content that breaks these rules is removed and its author loses access to Quests.

You keep ownership of what you write. You allow Ember to store it and show it to the members of the Quest you posted in, only to run the Quest.

5. Personal Initiations

A personal Initiation is a short script Ember writes from your answers, read aloud in an AI-generated voice by ElevenLabs. It is for your personal use. Do not enter anything you do not want sent to ElevenLabs for that purpose, as explained on the screen before anything is sent. The number of Initiations you can create may be limited.

6. Not medical advice

Ember's breathing, movement and break guidance, its music, and its articles about focus, attention and conditions such as ADHD are general information for wellbeing and productivity. They are not medical or psychological advice, diagnosis or treatment. Stop any exercise that causes pain or discomfort, and talk to a qualified professional about your health.

7. What belongs to Ember

Ember's music, voices, artwork, scenes, text, name and design belong to Ember or its licensors. You may listen to and use them inside Ember; you may not copy, extract, redistribute or resell them, or reverse-engineer the app except where the law allows it.

8. Availability and changes

I work to keep Ember running and your data safe, but Ember is provided “as is” and may sometimes be unavailable, change, or lose a feature. Features may be added, changed or retired; Pro subscribers will not lose what they paid for during a paid period without notice.

9. Ending

You can stop using Ember at any time and delete your account in the app (see account deletion). Deleting your account does not cancel an Apple subscription. Ember may suspend or close an account that breaks these terms, in particular the Quest rules.

10. Responsibility

To the extent the law allows, Ember is not liable for indirect or consequential losses, or for lost work, data or profits, arising from your use of Ember. Nothing in these terms limits liability that cannot be limited by law, or your rights as a consumer under the law of the country where you live.

11. Changes to these terms

If these terms change in a meaningful way, this page is updated and the change is stated plainly, before it applies. Continuing to use Ember after that means you accept the new terms.
